Relatives of the mother of a 9 year old girl shot and killed by an attacker in Texas have lashed out at the grand jury’s decision not to bring charges against the robber.

“What is wrong with all of you guys?”

Gwen Alvarez asked after the decision not to charge Tony Earls, 41, who police say fired the shots that killed fourth-grader Arlene Alvarez, believing his robber got into her family’s pickup.

“There are a lot of children dying. Our future is dying. … Where is the humanity? Where is your heart? Where is your soul?”

Police and prosecutors allege that Earls shot after being robbed at gunpoint at a Houston ATM on Valentine’s Day while with his wife.

On their way to supper, however, the Alvarez family’s pickup was pierced by a bullet, and the 9-year-old girl was killed. The following day, she was dead.

Why are you all so depressed? Gwen Alvarez enquired of the grand jury in her question.

Arlene Alvarez, a 9-year-old girl who was shot in the head by a Houston man who was trying to stop a robber, died after spending a day on life support.

Arlene Alvarez, a 9-year-old girl who was shot in the head by a guy who was trying to stop a robber in Houston on February 14, died after a day on life support.

Because Earls was also a victim of a crime, the grand jury decided not to file charges against him for the aggravated assault accusation. Because of the ruling, he will not face any further charges.

His eyes are opened to a new world. Even now, “my daughter still does not,” Alvarez’s mother remarked at the news conference.

“My daughter is still underground, much below ground. When she saw her daughter shot dead in front of her, “I don’t know whether she’s even good spiritually,” she remarked.

“We feel defeated because they arrived to a decision that we don’t agree with,” said April Aguirre, the late girl’s aunt.

It’s impossible to get Arlene back, Aguirre added. “Arlene will always be a four-year-old girl.” “Nine will always be her age.”

Kim Ogg, the Harris County District Attorney, said that the grand jury’s decision was “extremely difficult for the Alvarez family to absorb”

“The Alvarez family is in our thoughts and prayers since Arlene’s death is a tragedy that is incomprehensible,” Ogg said in a statement.

There is a $30,000 reward in place for the suspect who started this chain of events, and she says her office is “focused all of our efforts” on finding him.

According to Earls’ lawyers, they are pleased with the grand jury’s decision, complimenting the “careful deliberation” that went into it.

According to Tony Earls’ counsel, he opened fire after being robbed at gunpoint because “anyone in those situation would have done so.”

Lawyers Brennen Dunn and Myrecia Donaldson remarked that “Mr. Earls did what we feel anyone in that situation would have done,” per the New York Times.

“We are glad that justice was served for Mr. Earls, despite the emotion and difficult judgments that had to be taken in dealing with this matter.”

There is no greater loss than a loved one, and Earls’ family continues to mourn the death of such a wonderful spirit, Earls’ counsel stated.

“At the same time, we are pleased with the grand jury’s decision in this matter.”
